They Towed My Car!

If you have been arrested for a suspected DUI, it is likely that the police had your car towed away from the scene of the stop.  The word “impoundment” means that your car has been seized and is being held in legal custody by the state.  Generally, this means that the state has the vehicle and they will continue to hold it until it is released by a court.  The police agency may have a contract with a private towing company in the area, and they will be the one who has possession of the vehicle until it is redeemed by you.

However, there are ways that you can get your car back.  When you are arrested, immediately request to speak with an attorney.  We can file a Petition for the Release of the Vehicle with the court that is going to handle your case.  There may be some issues to deal with before the car can be released.

If you have 3 prior convictions for DUI in the past 6 yrs. your vehicle may be subject to forfeiture to the State of Ohio if the car is registered in your name and you are convicted of the 4th offense.
